Refund Policy

1. Overview

At KN Real Estate 215 LTD, we aim to deliver transparent and reliable agency services across sales, lettings, and property management. This Refund Policy details the terms regarding payments, holding deposits, service fees, and cancellation rights applicable to buyers, sellers, landlords, and tenants.

2. Holding Deposits (Tenancy Applications)

In accordance with the UK Tenant Fees Act 2019, holding deposits paid by prospective tenants to reserve a rental property are managed under strict statutory rules:

• Full Refund Granted: Your holding deposit will be refunded in full if the landlord decides not to let the property, or if KN Real Estate 215 LTD fails to process the tenancy agreement within the Deadline for Agreement (usually 15 days).
• Non-Refundable Scenarios: A holding deposit may be retained if the applicant provides false or misleading information during referencing, fails a Right to Rent check, or decides to withdraw from the tenancy application.

3. Residential Sales Fees

Our commission for residential property sales is charged on a "No Sale, No Fee" basis unless otherwise agreed in writing in your Client Instruction Agreement:

• No sales commission is charged if a property transaction fails to complete.
• If upfront marketing or professional photography packages are purchased separately, these costs are non-refundable once the service/media production has been fulfilled.

4. Lettings & Management Fees

Landlord fees for tenant find, referencing, or full management services are outlined in the signed agency contract:

• Management fees deducted from monthly rent are non-refundable for months where property management services were actively provided.
• In the event of contract termination under agreed cancellation terms, unused pre-paid service fees will be refunded pro-rata within 14 business days.

5. Right to Cancel (14-Day Cooling-Off Period)

Under Consumer Contracts Regulations, individual clients instructing KN Real Estate 215 LTD off-premises or at a distance (e.g., online or via phone) have a 14-day statutory right to cancel the agreement without giving reason, starting from the day the contract is signed.

If you request us to commence work immediately during this 14-day period and subsequently cancel, you may be liable for reasonable costs incurred for services rendered up to the time of cancellation.
